Acceptable Use Policy

Introduction

Tazapay Pte. Ltd. (the “Company”) is a Singapore incorporated Company with UEN 202010604W. The Company is regulated by the Monetary Authority of Singapore as a Major Payment Institution.
This Acceptable Use Policy (“AUP”) is aimed to provide a framework to Merchants on the activities that are not permitted in relation to the use of Payment Processing Service. The Policy has been developed with applicable AML/CFT laws, regulations, notices and guidelines issued by the MAS (collectively, the “AML/CFT Regulations”)
The Company’s Merchant Account Agreement, Privacy Policy are incorporated into this AUP whenever applicable. Together, they form a binding agreement between you and the Company. Any capitalized words used but not defined in this AUP have meanings as provided in the Merchant Account  Agreement.
You are responsible for complying with the all-applicable laws in relation to the use of the Payment Processing Service, regardless of the purpose. In addition to the aforementioned, you must adhere to the AUP and any breach of AUP shall also constitute breach of the Merchant Account Agreement.
Your use of the Payment Processing Service constitutes your acceptance of the AUP in effect at the time of your use.

Prohibited Activities

The Company does not permit businesses to conduct fraudulent or illegal activities through the Payment Processing Service  or misuse it for unwanted activities. If you are found to be in violation of the AUP, then the Payment Processing Service will be terminated immediately without any notice. Businesses that offer illegal products or services are never eligible to use Company’s Payment Processing Service.
The company uses the information obtained from you, publicly available information, government records/databases, and reliable and independent third party data sources to determine the nature of the business and appropriate industry classification. When a Payment Partner is involved in the fund flows for you then the prohibited industries list of Payment Partner is also taken into consideration to make the decision.
The list of prohibited industries used by the Company is as per the table below:

Counterfeit items
Credit repair services
Drugs or drug proprietors selling illegal substances
Drug paraphernalia
Espionage equipment and accessories
Gambling providers or transactions including games of chance
Human remains and body parts
Illegal or unlicensed investment schemes
Illegal downloads of movies, music, computer and video games
Illegal or unlicensed sale of financial information
Mail order brides services
Money changers
Online pharmacies, sales of prescription drugs/devices online
Outbound telemarketing
Pawn shops
Poisonous and hazardous materials
Products/Services promoting abuse, hatred, racism, religious persecution, terrorism, violence or contain offensive content
Pyramid or ponzi schemes
Sanction list inclusions (global)
Selling of likes/followers for social media
Shell banks and companies
Signal Jammers/Blockers that interferes with cellular/communication devices
Stolen goods including digital and virtual goods
Surrogacy services
Tattoo parlours or massage parlours
Tobacco / Cigar / Electronic Cigarette / Nicotine products
Trade of weapons, ammunition, military arms, explosive devices and firearm parts
Unlicensed tax, accounting and legal firms
Prohibited industries as per major card schemes

Risk Industries

The Company has developed a list of high risk/restricted industries pursuant to which it  may onboard select merchants subject to enhanced due diligence.
The list of high risk industries used by the Company is as per the table below:

Charities or Non-For-Profit organizations
Crowdfunding
Cryptocurrencies, synthetic or non-traditional securities
Digital games or virtual world credits
Dropshipping
Fantasy sports, e-sports gaming or tournaments
Games of skills not involving cash prizes
Gems, Jewellery & Silverware
Licensed financial services, licensed securities brokers & investments
Marketplaces
Private medical practice or online doctor consultation
Note: The lists of prohibited and high-risk/restricted industries are provided as a guideline for identifying areas that may require enhanced due diligence. However, these lists are not exhaustive, and the Company reserves the right to conduct enhanced due diligence based on additional factors or circumstances as deemed necessary. The decision to conduct enhanced due diligence is at the Company's sole discretion.
